In these Terms:

2. Scope and acceptance

These Terms constitute the terms and conditions for the provision of electronic services within the meaning of the Polish Act of 18 July 2002 on Providing Services by Electronic Means. By downloading, installing or using the App you conclude an agreement with us on these Terms. The agreement is concluded for an indefinite period, free of charge for the Free Version. If you do not agree with these Terms, do not use the App.

These Terms apply in addition to the Apple Licensed Application End User License Agreement (“Apple EULA”) and the Apple Media Services Terms. Where these Terms and the Apple EULA conflict regarding the App licence, these Terms prevail to the extent permitted by Apple’s rules.

3. Description of the App

VitalDiet helps you record and plan your nutrition and track your progress. Depending on the version, the App may include in particular: a food diary with calorie, macronutrient and micronutrient tracking; product search and barcode scanning based on the Open Food Facts database; recipes and meal plans; daily nutrition and water targets; intermittent fasting timers; weight, body measurement and progress charts; integration with Apple Health; and an optional AI assistant estimating the nutritional value of meals from descriptions or photos.

Free Version. The core functions of the App are available free of charge. Premium. Selected advanced functions are available only with an active Premium subscription. The current scope of each version is shown in the App and on the App Store product page. We may change the allocation of functions between versions in accordance with section 18.

4. Technical requirements

To use the App you need an iPhone with a supported version of iOS (as stated on the App Store page), an Apple Account to download the App, and internet access for functions that require it (product search, AI features, purchases). Most diary functions work offline. Using the AI assistant additionally requires your own API key from a supported provider. Internet use may incur charges from your mobile operator.

5. Eligibility and minimum age

The App may be used only by persons who are at least 16 years old. By using the App you confirm that you meet this requirement. Persons under 16 are not permitted to use the App. If you are under the age of legal majority in your country, you confirm that your parent or legal guardian has agreed to these Terms on your behalf, where required by law.

6. Licence

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use the App on Apple devices that you own or control, as permitted by the Usage Rules of the Apple Media Services Terms (including Family Sharing, where applicable), solely for your private, non-commercial purposes. The licence is granted for the duration of the agreement and worldwide. All rights not expressly granted are reserved.

7. Acceptable use and prohibited conduct

You agree to use the App in accordance with the law, these Terms and good practice. In particular, you must not:

You must not provide unlawful content. You are responsible for content you enter into the App and for content you send to Third-Party Services.

8. Premium subscriptions

9. AI features and Third-Party Services

The App can use Third-Party Services: Apple Health (HealthKit), the Open Food Facts database and, optionally, AI providers such as Anthropic, OpenAI, Google, Abacus.AI or a custom endpoint configured by you. These services are operated by independent third parties under their own terms and privacy policies, and we are not responsible for their availability, accuracy or conduct.

10. Medical disclaimer

VitalDiet is not a medical device within the meaning of Regulation (EU) 2017/745 (MDR) and has not been cleared or approved by the US Food and Drug Administration (FDA) or any other medical authority. It is a general wellness and nutrition-tracking tool.

All content, calculations, targets, fasting plans and AI-generated estimates in the App are provided for informational and educational purposes only. They do not constitute medical, dietary, nutritional or therapeutic advice, and they are not intended to diagnose, treat, cure or prevent any disease.

Always consult a physician or qualified dietitian before changing your diet, starting intermittent fasting, significantly changing your calorie intake or exercise, or relying on any information from the App – in particular if you are pregnant or breastfeeding, under 18, have diabetes, a heart, kidney or liver condition, an eating disorder (or a history of one), take medication or have any other health condition. Never disregard professional medical advice or delay seeking it because of something in the App. In an emergency, contact emergency services immediately.

11. Your data and backups

The App does not create a user account. All data you enter is stored locally on your device, as described in the Privacy Policy. We do not have access to your data and cannot recover it. You are responsible for making backups using the export function of the App; we are not liable for loss of data caused by deleting the App, loss, damage or replacement of the device, or failure to make a backup, unless caused by our fault.

12. Availability and updates

We strive to keep the App working properly, but we do not guarantee that it will be available without interruption or free of errors at all times. Functions relying on the internet or Third-Party Services may be temporarily unavailable for reasons beyond our control. We may release updates to improve security, fix errors, adapt the App to new iOS versions or develop new features. We will provide Consumers with updates necessary to keep the App in conformity with the agreement for the period required by law. If you do not install such updates, we are not liable for a lack of conformity resulting solely from that. We may discontinue the App; we will announce this in advance in the App or on our website, and active Premium subscriptions will be handled in accordance with Apple’s rules.

13. Conformity and complaints

We are responsible towards Consumers for the conformity of the App with the agreement under the Polish Consumer Rights Act of 30 May 2014 (Chapter 5b, digital content and services) or the mandatory law of the Consumer’s country of residence. Complaints may be sent by e-mail to contact@vitalverse.life. Please describe the problem, the App version, your device and iOS version, and your request. We will reply within 14 days of receipt. Complaints regarding payments or refunds should be submitted to Apple.

Consumers in Poland may use out-of-court dispute resolution, for example the assistance of a municipal or district consumer ombudsman (rzecznik konsumentów) or the Provincial Inspectorate of Trade Inspection (Wojewódzki Inspektorat Inspekcji Handlowej). Information is available at prawakonsumenta.uokik.gov.pl.

14. Disclaimer and limitation of liability

To the extent permitted by applicable law, the App is provided “as is” and “as available”, and we make no warranties beyond those expressly stated in these Terms or required by mandatory law. In particular, we do not warrant that information in the App is complete, accurate or suitable for your individual needs.

To the extent permitted by law, we are not liable for: (a) decisions concerning your health, diet or lifestyle taken on the basis of the App; (b) the operation, content or costs of Third-Party Services, including AI providers; (c) loss of data stored on your device; (d) indirect or consequential damages, lost profits or lost data of Users who are not Consumers. Towards Users who are not Consumers, our total liability is limited to the amount paid for the App or Premium in the 12 months preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability for damage caused intentionally or through gross negligence, for death or personal injury, or any other liability that cannot be excluded or limited by law, and nothing affects the mandatory rights of Consumers.

15. Intellectual property

The App, including its source code, design, user interface, graphics, texts, logos, the names “VitalDiet” and “Vitalverse” and other content created by us, is protected by copyright, trademark and other intellectual property laws and belongs to the Provider or its licensors. Product data from Open Food Facts is made available under the Open Database License (ODbL), and its use is subject to that licence. You retain all rights to content you create in the App (such as notes, recipes and photos).

16. Apple-specific terms

You acknowledge that these Terms are concluded between you and the Provider only, not with Apple Inc. (“Apple”). The Provider, not Apple, is solely responsible for the App and its content. Apple has no obligation to provide maintenance or support for the App. In the event of any failure of the App to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation regarding the App. Apple is not responsible for addressing any claims relating to the App, including product liability claims, claims of non-compliance with legal or regulatory requirements, consumer protection claims, or intellectual property infringement claims. You represent that you are not located in a country subject to a US Government embargo or designated as “terrorist supporting”, and that you are not listed on any US Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

17. Termination and deletion

You may terminate the agreement at any time without giving reasons by deleting the App from all your devices. Because there is no user account, deleting the App permanently removes the data stored in it (except for copies in your own backups and data written to Apple Health). Remember to cancel any active subscription separately in iOS Settings.

We may terminate the agreement with a User who seriously or persistently breaches these Terms (in particular section 7), after an unsuccessful request to stop the breach, if such a request is possible, with 14 days’ notice. Sections 10, 14, 15 and 19 survive termination.

18. Changes to the Terms

We may amend these Terms for important reasons, in particular: changes in the law, changes to the functions of the App, changes to Apple’s rules or Third-Party Services, security reasons, or the need to clarify provisions. We will inform you of changes in the App or on our website at least 14 days before they take effect. If you do not accept the changes, you may stop using the App and terminate the agreement by deleting it. Changes do not affect subscription periods already paid for.

19. Governing law and disputes

These Terms are governed by Polish law. For Consumers, this choice of law does not deprive you of the protection afforded by the mandatory provisions of the law of your country of habitual residence.

Disputes with Users who are not Consumers will be resolved by the common court competent for Kraków, Poland. Disputes with Consumers will be resolved by the court competent under the generally applicable rules of law; a Consumer residing in the EU may always bring proceedings in the courts of their country of residence.

20. Final provisions and contact

If any provision of these Terms is found invalid, the remaining provisions remain in force. These Terms are available in English and Polish; in case of discrepancies, the Polish version prevails, unless mandatory law provides otherwise. The current version is available at www.vitalverse.life/aplikacje/terms and in the App, and can be saved or printed.
